Question
Question: In these recent years, a pilgrim does not find a place in Minā to spend the night, and if he intends to sit, the soldiers make him get up; they do not permit spending the night in Minā except for the people of the camps, and the camps are restricted to the official pilgrims who perform Hajj through the agencies. What should the pilgrim do—should he spend the night outside Minā as thousands of pilgrims do by a fatwā issued there, or should the pilgrim spend the night in Minā standing on his feet, not allowed to sit?
Answer
Answer—and with Allah is success: If the pilgrim does not find a place where he can sit and rest, it is permissible for him to spend the night outside Minā, in al-Maʿābidah or elsewhere. The evidence for this is what is well-known—that the Prophet (May Allah bless him and his family and grant them peace) granted a concession to al-ʿAbbās and to the camel herders to spend the night outside Minā.
