Question: There is an irreligious man whom his wife sometimes hears denying life after death and rejecting Paradise and Hell; sometimes his children hear him as well. He sometimes prays as a mere formality in front of people. What is obligatory upon his wife? And how is his estate treated after his death?
Answer
Answer: The marriage between this man and his wife is not dissolved except by the ruling of the lawful judge.
- His estate is inherited by his Muslim heirs. The proof is that the Prophet (May Allah bless him and his family and grant them peace) treated the hypocrites as Muslims in matters of marriage and inheritance, despite what reached him about them of statements that necessitate disbelief—whether by revelation from Allah or by transmission of trustworthy Companions.
