Question
Question: Two men agree that one of them will import goods from abroad and sell them to the other for a known price. They then stipulate in this agreement that the importer must buy back half of what he sold to the other, at a known price and a known profit. Is it permissible to enter into this sale or not—bearing in mind that the price of the goods will be paid by a usurious bank, to which the goods do not belong; it merely stands as guarantor and undertakes the payment?
Answer
Answer (and Allah grants success): This sale resembles the type prohibited by the Prophet—May Allah bless him and his family and grant them peace—for it is authentically reported that he, May Allah bless him and his family and grant them peace forbade,“two sales in one sale,” and [forbade] “a sale with a condition [that is impermissible],” and the like. Believers are those who halt at doubtful matters; and in the hadith: “Leave what makes you doubt for what does not make you doubt.”
