Question

Question: A man performed ʿUmrah, but after ṭawāf and saʿy—and before shaving or trimming—he had intercourse with his wife out of forgetfulness. What is due upon him?

Answer

Answer—and Allah grants success: The scholars of the madhhab said that a camel (badnah) is required of him. Imām al-Hādī (peace be upon him) said: the most that is required is a sacrificial blood (dam). And from Imām al-Qāsim ibn Ibrāhīm (peace be upon them): the most that is required of him is a sacrificial blood; and if he does not shed a blood, I hope there is no harm upon him. Thus it is related in the Manasik of al-Mawlā Majd al-Dīn—may Allah be pleased with him.
I say: The most equitable of these statements is that of Imām al-Hādī (peace be upon him), because it is related from some of the Imams and scholars—including Imām al-Qāsim (peace be upon him)—that shaving or trimming in ʿUmrah is not itself a ritual act (nusuk), but rather a means of releasing a prohibition.
