Question

Question: A man performed Hajj and then ʿUmrah after Hajj. He then went to Jeddah for a need and returned to Makkah where he resides, with no intention of ʿUmrah—only to take his belongings and return to his companions. Is he required to enter iḥrām or not?

Answer

Answer—and Allah grants success: The closer view is that he is not required to enter iḥrām, because:
1. He is in the ruling of a resident. If a resident intends to stay in a place for ten days, then goes out during that period for a need—one mile or one barīd—and returns to complete his stay, that does not cut off the ruling of residence. Thus said the scholars of the madhhab. By analogy, the resident in Makkah who goes outside the miqāt limits and then returns to complete his residence is treated likewise.
2. He had no intention of Hajj or ʿUmrah when returning to Makkah.
3. Many scholars—from Ahl al-Bayt (peace be upon them) and others—hold that iḥrām is only obligatory upon one who intends one of the two rites, and this is preferable due to the ease it entails, which is a hallmark of this upright, gentle religion.
