Question

Question: A layman left ʿArafah after sunset, passed through Muzdalifah and left it without spending the night there. What is required of him?

Answer

Answer: Based on the principle that “the madhhab of the layperson is the madhhab of the one he follows,” nothing is required of this uninformed person. One may adduce as evidence His saying, “And there is no blame upon you for that in which you have erred, but [only] for what your hearts intended.” [al-Aḥzāb:5], and His saying, “Allah intends for you ease and does not intend for you hardship.” [al-Baqarah:185], and His saying, “And He has not placed upon you in the religion any difficulty.” [al-Ḥajj:78].
If it is said: the jurists of the madhhab obligate multiple blood-sacrifices upon one who did such things—why, then, do you drop them here?
We say: they obligated them upon other than the pure layperson. As for the pure layperson, they ruled the validity of what he performed while believing it to be correct, so long as he did not violate consensus—and this layman we mentioned did not violate consensus, for there are recognized madhhabs that do not require spending the night in Muzdalifah, nor … etc.
