[Selling the Goods Back to the Seller]

Question: A man bought goods from another man, paid their full price, took possession of the goods, and left them with the seller. Later the buyer came and offered those goods to the seller to buy back at less than he had purchased them for. Is that valid and permissible or not?

Answer—and Allah grants success: What appears to me—and Allah knows best—is that this is permissible and valid. The proof is His saying Most High, “And Allah has permitted sale and forbidden usury” [Al-Baqarah:275]. What is prohibited and invalid is that a man purchases a good on credit, then sells it back to the seller for less than he bought it for—the two of them doing so as a stratagem to reach usury. This issue is called “al-ʿīnah.”  Al-ʿīnah: (is a modal of commodity or the like, representing it with its characteristics and attributes.)
