Question

Question: A man owed a dam in Hajj. He bought a ram and gave it to a poor person before slaughtering it, being ignorant that giving the dam to the poor is not valid except after slaughter. He only realized this mistake some time later. What is required of him?

Answer

Answer—and from Allah is success: What I incline to is that this suffices for him:
1. Because the Prophet (May Allah bless him and his family and grant them peace) excused mistakes in some partial acts of Hajj; and “There is no blame upon you for what you have done by mistake, but [only] for what your hearts intended.” [al-Aḥzāb:5]
2. Ignorance is often a cause of pardon in many legal rulings.
3. The issue is speculative and juristic; error in such matters is pardoned—both for the jurist and the ignorant.
