Question

Question: If a husband prevents his wife from visiting her parents, is it permissible for her to visit them without his permission or not?

Answer

The answer—and Allah is the One who grants success: Allah—Glorified and Exalted—referred the reciprocal rights of spouses to what is customary, saying: "And due to the wives is similar to what is expected of them, according to what is reasonable." [Al-Baqarah:228]. What is “reasonable” (maʿrūf) is what people recognize and customarily practice. On that basis, if what is customary among the people of a given town or village is that a wife visits her parents—or either of them—once every day, or once every two days, or once every three days, then it is permissible for her at that point to visit them even without the husband’s permission.
If a woman wishes to visit her parents more frequently than what the people of her town customarily do, then that is not permissible for her except with his permission. This detail is derived from the verse: "And due to the wives is similar to what is expected of them, according to what is reasonable; but the men have a degree over them." [Al-Baqarah:228].
