[Transferring a waqf endowed to the Meccan pigeons to a mosque]

Question: There is a jarbah (field) endowed to the pigeons of Mecca. We have observed that the pigeons of Mecca are well-provided for by the grain pilgrims and visitors throw them throughout the year. Is it valid and permissible to transfer the waqf’s benefits to the village mosque when it is in need?

Answer—and Allah is the One who grants success: That is permissible for several reasons:
1. The jurists of the school allow transferring a mosque’s surplus to another mosque or a general public interest; what is mentioned in the question is analogous and close to that.
2. A waqf for animals is invalid according to the school’s established doctrine; on that basis, with the beneficiary being in no need, the case for transferring to the mosque is stronger.
3. Many scholars permit transferring a benefit to what is more beneficial. Here, the needy mosque is worthier and more beneficial than the Meccan pigeons—especially if the mosque is frequented by many worshippers.
