[Pronouncing Divorce by an Ignorant Person Who Does Not Intend It 2]

Question: A young man would often swear by divorce, saying: “It is ḥarām and divorce from my wife that I did (such-and-such) / or that I did not do it,” while he was lying. He did that out of carelessness with divorce and scant religiosity, and it occurred from him beyond count. He later had children; when he heard admonitions, he feared the consequences of what had passed and asked for a way out. How is that?

The answer—and Allah is the One who grants success: The unaffiliated layman who has no fixed madhhab has his past actions borne upon the best construals—namely, that they be treated according to the madhhab of whichever mujtahid they accord with.
