Question: A man has a muḍārabah capital that realized profit. The owner then told the managing partner to build a structure from the profit, and he did so. Later, a dispute arose between them at the time of division. May the managing partner count a wage for supervising the construction, knowing that he had no intention of hire except at the time of division; at the time of construction, he had no intention of being hired?
Answer—and Allah grants success: What appears to me—Allah knows best—is that he does not deserve a wage. The default, as the jurists of the school say, is that usufructs are permissible (without charge); he did not intend hire at the time of the work; and he was acting in a matter of shared interest between himself and the owner.
