[Do Two Value-Based Wrongful Claims Offset One Another if Equal?]

Question: Two men each has against the other a monetary wrong that is qīmī (value-based, not fungible). If the two wrongful claims are equal in value, do they offset one another? Or must each deliver to the other what he owes?

Answer: If it is known that the two values are equal according to both men and in reality, then the two wrongful claims offset one another.
But if one or both of the claims are of things whose value varies from person to person and from time to time, then both parties must mutually agree to set them off; one-sided offset does not suffice—unless it is known that what he owes is more than what the other owes, by the valuation current among people at all times.
