[Concluding a Marriage Contract for a Boy to a Girl]

Question: A marriage contract was concluded marrying a boy to a girl. Then the girl reached puberty and the time for her marriage came, while the boy is still young and not yet at the time of marriage. Waiting for the boy to reach the age of marriage harms the girl and exposes her to temptation, and when the boy does reach the age of marriage he may not accept her due to her being older than he.
The boy’s guardian knows all this, acknowledges it, and wishes to relieve the girl from her predicament, and even testifies that the girl is harmed by waiting and exposed to temptation. What is the solution and way out?

Answer—and Allah grants success: The girl’s guardian or agent and the boy’s guardian should go to the judge and lay out their case before him. If the judge recognizes the harm to the girl, he must remove that harm by dissolving the marriage, or by issuing a divorce on behalf of the boy.
